The suit forces courts to decide whether AI-generated deepfakes qualify as protected speech or whether states can impose liability on the labs that build the models. If xAI loses, frontier developers face a patchwork of state bans and potential criminal exposure. If it wins, the ruling could entrench a liability shield that leaves victims with few remedies and regulators with limited tools to police harmful outputs. The case arrives as legislators in at least six other states draft similar measures.
